High Court Allows Pamela Ling to Challenge Arrest Warrant and Travel Ban

KUALA LUMPUR – Today, the High Court approved Datuk Seri Pamela Ling Yueh’s application for permission to initiate judicial review proceedings aimed at challenging both the arrest warrant and travel limitations that were enforced against her previously.

Justice Datuk Amarjeet Singh determined that several contentious matters warrant additional scrutiny in the proceedings and scheduled June 3rd for case management.

In the course of the hearing, Ling was legally represented by advocate Datuk Malik Imtiaz Sarwar, whereas senior federal counsel Mohd Faisal Md Nor spoke on behalf of the respondents.

On April 7, Ling, who is 42 years old, submitted a judicial review application, identifying the Malaysian Anti-Corruption Commission (MACC) and the Director-General of the Immigration Department of Malaysia as the primary and secondary respondents, respectively.

Nonetheless, Ling was reported as missing on April 9 when she was traveling to the MACC headquarters via an e-hailing service. She had been expected to furnish her statement there regarding an active inquiry.

In her application, Ling, who has been living in Singapore since 2008, is requesting an order to annul the warrant for her arrest effective immediately. This warrant was issued on December 2, 2024, by the Johor Bahru Magistrate’s Court.

The woman who has three children is additionally requesting a ruling stating that the first respondent (MACC) does not have the power to prevent, either directly or indirectly, anyone from exiting Malaysia unless such prohibition is governed by the MACC Act 2009 and the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.

She additionally requests an order for the swift return of her mobile phone from the MACC, a writ of mandamus directing the second respondent to permit her departure from Malaysia, along with compensation totaling SGD20,401.14 and RM70,000, plus legal fees.

In her supporting affidavit, Ling argues that the MACC does not have the legal power to direct the immigration authorities to enforce a travel ban on her starting from October 2024.
